Blockchain and Crypto Law

The legal landscape for blockchain and cryptocurrency is still evolving, and there are a number of issues that need to be addressed. For example, how will these new technologies be regulated? What types of activities will be considered illegal? And what implications do they have for existing laws?

These are just some of the questions that need to be answered as the blockchain and cryptocurrency industries continue to grow. This are all areas that we are able to advice you on.

It’s important to remember that blockchain and cryptocurrency are still relatively new technologies. This means that the law is still catching up to them, and there are bound to be some bumps in the road. Be prepared for changes in the law, and don’t be afraid to consult with us if you’re unsure about something.

A Passion for NFT's Law

Being an artist herself, Nicolle developed a passion for NFTs and became curious about the intellectual property and copyright surrounding NFTs. Soon after, this curiosity expanded into dealing and consulting with start-ups, DeFi, DAO formation, and federal regulations surrounding web3 investments.

She advances her knowledge and skills in web3 and is working hard to create legal precedent through her practice. Passionate about her Latin background, Nicolle works tirelessly to educate and create inclusion for the Latin community in the Web3 space.

Blockchain Law Areas

Blockchain technology is revolutionizing the world by allowing us to transact at a global scale through smart contracts, cryptocurrencies, and a distributed ledger system.

Ethereum Blockchain is the most common blockchain. It was created in part, to enable smart contracts.

Smart contracts are not contracts in the traditional way. It is a set of self-executing codes providing specific instructions upon the fulfillment of the terms encoded within. Smart contracts contain the NFT’s unique ID and metadata that govern the transferability of the digital asset as well as any patent and copyright assignment/ownership. They provide creatives and intellectual property owners an alternative avenue for profit.

Intellectual Property (IP) issues are on the frontline of NFTs and the crypto world. Some of the current issues include commercial rights being transferred or lack thereof and instances where there are multiple creators. Lafosse Law has the tools and knowledge to help you draft the terms and conditions specific to your project and minimize commercial rights issues.

Creators are busy creating and developing mind-blowing projects and tend to oversee and address private key management agreements, royalty allocation, and collaboration agreements. Some of these issues are yet to be solved through smart contracts and existing technology. Real-world contracts are necessary to complement smart contracts and Lafosse Law is ready to take on the lead. We will help you formalize the agreements you have made with your business partners and team members.

Decentralized Autonomous Organizations (DAOs) are the new way of creating a corporation in web3. DAOs have the same purpose as any real-world corporation, to manage the business through voting rights. One of the main differences is that DAOs don’t have a board, instead, they are managed by their members who have tokens that reflect their voting rights. As of today, the only state that approves and legally recognizes DAOs is Wyoming.

Start-ups are the beginning of your business goal and dream. Our goal is to help you build a business and stay protected from potential future liabilities. Lafosse Law has a passion for business growth and our dream is to see you succeed.
